The requirement most sellers meet for the first time in escrow

Across much of the East Bay, the private sewer lateral connecting a house to the public main must be tested and certified when the property changes hands. The requirement grew out of a federal consent decree addressing sewage overflows into the Bay during heavy rain, and it is administered through EBMUD's Regional Private Sewer Lateral Program.

Sellers in Oakland, Berkeley, Alameda, Albany, Piedmont, Emeryville and neighbouring communities encounter it routinely. Most have never heard of it until a week into escrow.

What the test involves

A licensed plumber isolates the lateral and pressurizes it, usually with air or water, to see whether it holds. A camera inspection typically accompanies it. The line either passes or it does not.

Older laterals frequently do not. Clay pipe from the 1920s through the 1950s cracks, joints separate, and tree roots find the gaps. In neighbourhoods with mature street trees the failure rate is high enough that experienced agents simply assume replacement until proven otherwise.

A passing test produces a certificate valid for a defined period. That certificate is what the transaction actually needs.

What it costs

The test itself is a few hundred dollars. Replacement is the number that matters, and it varies enormously with distance to the main, depth, and what sits on top of the line.

A short straight run under a lawn might be five to eight thousand dollars. A long run under a mature driveway, a retaining wall, or a city street requiring traffic control and street-cut permits can reach twenty-five thousand or more. Trenchless methods reduce surface damage but are not always feasible.

The wide range is precisely the problem: neither party knows which end of it applies until the camera goes in.

Who pays

Negotiable, and negotiated differently depending on the market. In practice the seller usually ends up carrying it, either by doing the work before closing or by crediting the buyer.

What sellers underestimate is the schedule impact. A failed test discovered in week two means finding a plumber, pulling a permit, possibly obtaining an encroachment permit from the city for work in the right-of-way, scheduling the excavation, and getting the re-test. Four to eight weeks is common. Buyers with rate locks and moving dates do not always wait.

Test before you list

This is the single most useful thing a seller in the East Bay can do, and it costs a few hundred dollars.

Testing early converts an escrow emergency into a planning decision. You learn whether you are facing six thousand dollars or twenty-six thousand, and you decide calmly whether to fix it, price it into the listing, or sell to someone who will handle it. You also remove the buyer's ability to reopen negotiation over an unknown, because it is no longer unknown.

Selling without doing the work
